Terms of Service

Effective date: April 3, 2023

By purchasing, enrolling in, or using any membership, service, or facility of NailSalon.Club (“Company,” “we,” “us,” or “our”), you (“Member,” “you”) agree to be bound by the following Terms of Service (“Terms”).

1. Membership Eligibility & Private Club Nature

NailSalon.Club is a private, members-only nail salon and service club. Membership is granted at the Company’s discretion and is non-transferable unless explicitly stated.

We reserve the right to accept, deny, suspend, or revoke membership for violations of these Terms, misuse of services, or conduct inconsistent with the standards of the club.

2. Membership Tiers & Billing

  • Memberships are offered in tiered formats (including but not limited to Premier, and Founder tiers).
  • Membership fees are billed on a recurring basis (every 4 weeks or otherwise as disclosed at sign-up).
  • Fees are subject to change with advance notice. Changes will not affect prior billing periods.

3. Appointments & Scheduling Rules

To ensure a premium experience for all members:

  • All services require a confirmed appointment.
  • Appointments are subject to availability and capacity limits.
  • Membership does not guarantee unlimited or on-demand access.
  • Services must be used within the designated billing period unless otherwise stated.

4. Late Arrival Policy

  • Members arriving more than 10 minutes late may have their service shortened or modified.
  • Members arriving 15 minutes or more late may be treated as a no-show.
  • Late arrivals may forfeit the appointment without refund or service credit, at the Company’s discretion.

5. No-Show & Cancellation Policy

  • Appointments must be canceled or rescheduled within the required notice window (as stated during booking).
  • No-shows or repeated late cancellations may result in:
    • Loss of that appointment
    • Service forfeiture
    • Temporary booking restrictions
    • Additional fees or account review

6. Guest Policy

  • Guest privileges, if included, are limited to the terms of the Member’s tier.
  • Guests must comply with all salon rules and conduct standards.
  • The Member is fully responsible for their guest’s behavior, charges, and damages.
  • Guest privileges may be revoked without notice for misuse.

7. Conduct & Club Etiquette

Members agree to maintain a respectful and professional environment.

Prohibited conduct includes but is not limited to:

  • Harassment or abusive behavior toward staff or other members
  • Disruptive behavior
  • Intoxication or illegal substances
  • Damage to property
  • Recording staff or other members without consent

Violations may result in immediate suspension or termination of membership without refund.

8. Health, Safety & Service Limitations

  • Members must disclose relevant health conditions that may affect services.
  • Services may be refused if deemed unsafe or inappropriate.
  • NailSalon.Club is not responsible for reactions due to undisclosed medical conditions or allergies.

9. Refunds & Cancellations

Refunds and cancellations are governed by the Refund & Cancellation Policy, which is incorporated into these Terms by reference.

Key points include:

  • Pre-sale memberships are refundable if the salon does not open by Winter 2027.
  • Post-opening cancellations require 14 days’ written notice.
  • Cancellation fees may apply equal to waived enrollment or initiation fees.

10. Suspension or Termination of Membership

We reserve the right to suspend or terminate membership without refund for:

  • Abuse of services
  • Repeated no-shows or policy violations
  • Fraudulent activity
  • Failure to comply with these Terms

11. Limitation of Liability

To the maximum extent permitted by law:

  • NailSalon.Club is not liable for indirect, incidental, or consequential damages.
  • Liability is limited to the amount paid by the Member in the most recent billing cycle.

12. Changes to Services or Club Operations

  • Services, amenities, hours, staffing, and offerings may change without notice.
  • Membership access is subject to operational constraints, holidays, or special events.

13. Intellectual Property

All branding, content, designs, and materials are the exclusive property of NailSalon.Club and may not be reproduced without permission.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
